Peter Mutharika is the presidential candidate of the former ruling Democratic Progressive Party (DPP) in elections due next year.
To seal the strained relations between the two former political buddies, Mr Mutharika quit the UDF and founded his own Democratic Progressive Party.
Mutharika was elected under the former president's United Democratic Front Party in 2004, but left it soon after and formed the Democratic Progressive Party.
There was a heavy police presence outside court, where hundreds of supporters of the former ruling Democratic Progressive Party (DPP) gathered, but, unlike on Monday, there was no violence, he says.
"(The) Malawi Congress Party ... will not accept the results if Dr. Bingu wa Mutharika and the Democratic Progressive Party are declared winners in these elections, " the opposition party said in a statement signed by Tembo late Thursday, according to Malawi's Daily Times.

It is composed of progressive-minded independents and defectors from coalition members Sakigake and the Social Democratic Party (SDP).
Parliamentary elections that month saw a high turnout of 84% and a narrow win for the Progressive National Party, which took eight seats to the People's Democratic Movement's seven.
Assemblyman David Ervine and Dawn Purvis of the Progressive Unionist Party and the Lisburn councillors Gary McMichael and David Adams of the Ulster Democratic Party were involved in the discussions which were described as "an exploratory dialogue".
