However, several faults come to light after a period of years. 但同时经过一段时间的运行,其缺点逐渐暴露出来,本文就其暴露的缺点,比如受理审查权和发回重审权的缺失,DSB报告是否具有先例效力,常设上诉机构设置存在缺陷,个别案件“拒绝司法”,上诉复审期限太短,上诉复审程序缺乏透明度等等,进行研究和探讨,并提出了完善的建议。
