公司法人是企业的一种组织形式。以营利为目的的社团法人。在资本主义国家中也称为商事公司，是依照商法或有关法律成立的营利为目的的企业组织，包括无限公司、有限公司、两合公司、股份公司以及股份两合公司等。英美法中的公司法人与大陆法有所不同，既包括营利性的也包括非营利性的，且仅指有限责任公司。我国公司形式多样，大体上分为集资型和非集资型两种。集资型公司类似西方国家的公司，是由股东投资而成立，为企业联营的一种重要形式，非集资型公司属单一企业性质，如鞍山钢铁公司等。
