  目前,《中华人民共和国反垄断法》(下文简称《反垄断法》)虽已出台,迫切顺应了我国经济发展的立法需要,但内容还很不完善,尤其是没有明确规定反垄断执法机构的设置,仅授权国务院另行规定,这不可不谓是一大立法缺憾。
