Abstract: The judges in the judicial process in the application of the law reflects the discretionary power of judicial initiative. China's Supreme People's Court issued mainly by the large number of abstract way of judicial interpretation to guide judges in the case pending the application of the law, which the exercise of judicial initiative in the theoretical circle and practical caused a certain amount of controversy. We should objectively look at the power of judicial interpretation of China's Supreme Court, and in the future development of our country should be in the purification of the existing system of judicial interpretation and pre-trial level based on the reform of the system, supplemented by case, and gradually expand the judges in the cases pending legal interpretation.
