Comparing competency to make will, forms of wills, heir's portion, revocation and alteration of a will and testamentary executor between China and the West, this article focuses on making some simple suggestions on these five systems in China.
本文主要通过比较世界上主要法系国家法律与中国法律对遗嘱能力制度、遗嘱形式制度、对遗嘱自由原则的限制手段之一——特留份制度、遗嘱的撤回和变更制度、遗嘱执行人制度等五项制度的规定，就遗嘱继承中的这五项制度对我国将来的继承立法提出一些粗浅意见。
