【Abstract】 Currently, economy globalization and finance liberalization trend in full swing, the depth of china opening will be further strengthened, commitments which china actively fulfill to join the World Trade Organization will make further open china finance market, foreign-funded banks and china-funded banks will further intensively compete, the impact of international finance crisis has not completely eliminated, impact on industry from international finance led to a deep recession of economy in the world, in this context, this article pointed out inadequate of commercial bank supervision of China current legal system, and try to explore and study establishing the legal system of commercial bank supervision in order to adapt to china reform and opening.
