专利申请是获得专利权的必须程序。专利权的获得，要由申请人向国家专利机关提出申请，经国家专利机关批准并颁发证书。申请人在向国家专利机关提出专利申请时，还应提交一系列的申请文件，如请求书、说明书、摘要和权利要求书等等。在专利的申请方面，世界各国专利法的规定比较一致，但也存在许多差异。 专利申请是发明人、设计人或者其他有申请权的主体向专利局提出就某一发明或设计取得专利权的请求。依中国专利法规定，专利申请应向专利局提交申请书、说明书、权利要求、摘要、附图、优先权请求。其中附图、优先权请求这两个文件就每个申请而言，并非均必不可少，但这有利于专利申请。专利申请案中，申请书应以书面形式，主要载明如下内容：授予专利的请求、发明或设计名称，申请人姓名及身份，代理人姓名及身份、签名。
