交易习惯
交易习惯是一个名词，指当事人双方经常使用的习惯做法。“交易习惯”是指在交易行为当地或者某一领域、某一行业通常采用并为交易对方订立合同时所知道或者应当知道的做法；或者指当事人双方经常使用的习惯做法。交易习惯不同于习惯法，因为交易习惯的效力是基于当事人意思而产生。从这个角度出发，如果在合同中有明确的条款同某种习惯做法相冲突时，则这种习惯做法就不能被认定为交易习惯。
