形成权
形成权，是指依照权利人单方意思表示就可以使已经成立的民事法律关系发生变化的权利。如法定代理人对限制民事行为能力人超越其行为能力与他人订立的合同加以承认，这个合同就从效力待定变为有效了，这叫追认权；合同有效成立以后,由于出现法定情形一方可以通知另一方解除合同，合同关系即告消灭,这叫解除权。这些权利均属于形成权。形成权适用除斥期间的规定，不适用诉讼时效的规定。
