法条竞合
法条竞合，指一个犯罪行为同时触犯数个具有包容关系的具体犯罪条文，依法只适用其中一个法条定罪量刑的情况。法条竞合在德国刑法理论上，占支配地位的观点将其分为特别关系、补充关系和吸收关系。日本刑法理论的通说认为，法条竞合除了上述三种形式外，还有择一关系这种形式。所谓择一关系，是指可以同时适用于一个行为的数个构成要件相互处于可以两立的关系时，只适用其中某一构成要件，排除其他构成要件的适用。不过，日本也有学者认为，择一关系所针对的情形，实际上只不过是事实认定的问题，并非各法条本身的竞合。
