盗窃未遂
盗窃未遂是犯罪未遂的一种。刑法第二十三条第一款对犯罪未遂的定义是：“已经着手实行犯罪，由于犯罪分子意志以外的原因未得逞的，是犯罪未遂。”这是对犯罪未遂从主客观两个方面总的原则性界定。这一原则性界定也同样适用于盗窃未遂，即盗窃者实施盗窃时在客观上“已经着手”，但又“未得逞”，是盗窃未遂。
