营业所是指商主体依法确定的，从事商业营业的固定场所。商主体的营业所和民事主体的住所具有相同的痒律意义，它们均表明主体的外部特征，但前者依商法或商业登记法确定和变更，后者依民法的一般规则确定和变更。商主体可以有多个营业所，其数个营业所之间依法发生主从关系；大陆法多数国家的民商法规定。
