行纪合同
行纪合同是行纪人根据委托人的委托，以自己的名义为其办理购销、寄售等事务并收取酬金的协议。行纪制度源自罗马法，旧时又有固有行纪与非固有行纪之分；前者指以货物和·有价证券购销事务为标的的行纪，后者指以非购销事务为标的但符合行纪要件的合同关系，包括承揽行纪，运送行纪等。中国古代“邸店”、“牙行”所从事的寄售业务，本质上亦属行纪。行纪合同的特点：（1）行纪人以自己的名义为委托人办理行纪事务，其行为直接为自己设定权利义务，其行为后果也由自己承担，（2）行纪人以委托人的费用办理购销、寄售等事务，其购销取得的财产归委托人所有；(3) 行纪合同只能是有偿合同。
