超额保险
超额保险是指保险金额大于保险价值的保险。超额保险的产生,或是当事人因善意或恶意投保的保险金额高于保险价值,或是保险标的价值在订立合同后跌落,而使保险金额超过了保险价值。关于超额保险的法律后果《保险法》第55 条第3 款规定:“保险金额不得超过保险价值。超过保险价值的，超过部分无效，保险人应当退还相应的保险费。”
