【Abstract】 This paper discusses the rationality of public lending right from the perspective of philosophy of law and economics. First of all, the author explains the public lending right. Then he discusses the rationality of right patterns about public lending right, using labor theory of property and personality theory of property and theory of public goods from the perspective of philosophy of law and economics. After demonstration, this paper proposes there are rationalities about the right patterns of public lending right, therefore we should view the new public lending right objectively and wholly in stead of positive or negative blindly.
